Bad Employees and Gaps
in the Labor Law

Returning to Today's Topic.

This topic is recurrent when it comes to "Labor Rights and Human Rights" when the legislation in many countries does not speak exclusively of the Latin American region "They have gaps within" what to do with various "Harmful" activities from employees to companies and from the sanctions that these bad behaviors derive since many government or corporate employees seek protection from the authorities, sometimes invoking even "Human Rights" and the question arises: ¿How far do Labor and Human Rights apply when a willful or bad faith work affects a third party in this case the employer and when it is sometimes very expensive or irreversible?

Although there have been great advances in obtaining fairer “Labor Rights” and for the benefit of the working class, current times in a globalized world demand that the Authorities of the countries, the Unions and workers “In an ideal world” need to be regulated or obtain new tools to generate a balance between the parties. In this regard, some time ago, I had read in some thesis of Laws in Mexico City that a “Bureau of Workers” for the revision of complete Labor Back Ground Check, managed by the Authorities of the country to qualitatively known of employees, was proposed to the current labor legislation. to disclose to the new employers of this person their complete background such as: Marital Status, Number of Children, Places where they have lived, Education, Background of their previous employers, Social Networks, Criminal History, among others, as well as the trials that have taken carried out in detail to investigate qualitatively and determine according to this thesis if you are a troubled or lazy worker and avoid some dependency such as drug addiction for example. Which at first seemed like a different idea to the conventional one but let's imagine that now we add a deep personal investigation such as Ideology or Religion, and an Antidoping in the pure Nazi style but… “This is where the legal gap come from Regarding what can or cannot be done and what could be violating or attacking the "Labor Rights and Human Rights" of the person, which is also a fundamental issue.

But there are other gaps related to labor issues in the countries such as:

1.- Home Worker.
2.- People in Areas of High Marginalization and High Poverty.-
3.- Permanent Disabled.
4.- Illegal Inmigrants.
5.-Single Mothers and Fathers.
6.-Students without a Professional Degree.
7.- Adults over 60 years old.
8.- Child and Youth Sexual and Labor Exploitation. Here is the greatest Opportunity Area for the governments of the different countries and we will see this in detail later explaining the circumstances of child and youth exploitation and the Sexual Exploitation that they are important issues that go hand in hand but they are issues with different circumstances.
This project that has remained in the books of Law and Legal Jurisprudence pending, the jurisdiction of each country is responsible for attending in the best way to these issues that should be part of the daily agenda of politics and economic development in the countries.
